MEMBERSHIP AGREEMENT & PRIVACY POLICY

This agreement is made between the website www.bettyandsam.com and the member under the following terms and conditions.

By completing the registration process and confirming their email address, the member may begin using the site by entering their email address and password, provided they agree to the terms outlined in this agreement. To establish this membership agreement, it is sufficient for the user to enter the required registration details and password, accept the terms and/or permissions, and click the “Create Account” button.

If this agreement is concluded on behalf of a legal entity, the individual entering into the agreement declares and guarantees that they are authorized to act on behalf of that entity. Otherwise (if acting without authority), they accept full personal liability for any and all legal consequences resulting from their actions.

The Company reserves the right to unilaterally update or change the following terms at any time in accordance with legal regulations, or with the user's prior consent via email.


ARTICLE 1 – RIGHTS AND OBLIGATIONS OF THE MEMBER

1.1. The website www.bettyandsam.com is open to all users. Services offered on the site are free of charge.

1.2. The member agrees to use the site in compliance with this agreement and all other rules and policies specified on the website.

1.3. The member agrees to abide by all applicable laws while using the services provided on the site, including but not limited to the Turkish Code of Obligations, Turkish Penal Code, Turkish Commercial Code, the Law on Intellectual and Artistic Works, Trademark and Patent Protection Law, and the Law on the Protection of Personal Data. The member accepts full legal, criminal, and financial responsibility for any misuse.

1.4. The member agrees to compensate the company for any damages arising from breaches of this agreement. The company retains the right to seek reimbursement for any compensation, administrative or judicial penalties paid to third parties or government institutions due to the member’s actions.

1.5. The member may not interfere with other members' or visitors' use of the site, overload servers or databases with automated programs, or attempt to manipulate data. Violation of these terms may result in termination of the membership and legal liability.

1.6. Records belonging to terminated memberships may be retained by the company in accordance with the Law on the Protection of Personal Data. However, the company is not obligated to keep these records and may delete them at any time. The member cannot claim rights or compensation for deleted records but retains the right to request information on their personal data as outlined in Article 5.

1.7. The member declares that all personal and other information provided during registration or shopping is accurate and up to date. Inaccurate or outdated information may result in liability for any damage suffered by the site.

1.8. The member assumes all risks for links provided on the site for informational purposes, including links that lead to third-party websites.

1.9. All visual and textual content on the site is for personal use only. Unless otherwise specified, no content (text or photos) may be used for commercial or personal purposes without permission or citation. Publishing any site content or creating external links without company authorization is prohibited.

1.10. The member agrees not to copy, distribute, share, resell, modify, exhibit, reproduce, or create derivative works from the company’s copyrighted content on the site. Any such actions will result in full liability for damages.


ARTICLE 2 – RIGHTS AND OBLIGATIONS OF THE COMPANY

2.1. The company reserves the right to cancel transactions, suspend or terminate memberships, or terminate this agreement unilaterally in the following cases:

  • (a) If the user registers false, incomplete, misleading, or unlawful information;

  • (b) If the user partially or fully copies or attempts to copy site content;

  • (c) If the user shares their account credentials with third parties, resulting in misuse;

  • (d) If the user engages in activities that threaten site security or disrupt site operations;

  • (e) If the user exploits technical vulnerabilities for unfair benefit;

  • (f) If the user violates site policies, terms of use, or applicable laws.

2.2. The company will operate in accordance with its privacy policy during use of the site. However, the site is obligated to retain user information when required by law.

2.3. The site may collect and process various types of data (e.g., name, email, gender, IP address, browsing statistics) for purposes such as service improvement, promotional activities, and personalized user experiences. This information may be shared with domestic or international business partners (e.g., delivery, call center, database service providers) under appropriate security measures, and used in marketing, product development, trend analysis, or customer segmentation.

2.4. If the member chooses to pay via credit card, they agree that credit card details (card number, expiration date, CVV2 code) may be shared with the relevant financial institutions to complete the transaction.

2.5. The company reserves the right to use all membership-related information for marketing purposes during and after the term of this agreement, provided it complies with applicable data protection laws.

2.6. Except for legal obligations or purposes stated above, the company will not share user data with third parties and will ensure secure access to the agreed services.


ARTICLE 3 – TRANSFER, SCOPE, DURATION, AND TERMINATION

3.1. By registering, confirming their email, or using any service on the site, the member agrees to this agreement. It remains valid until the membership ends or is terminated under the listed conditions.

3.2. The company reserves the right to cancel a membership at any time with justification.

3.3. The company may unilaterally amend this agreement. Any updates will be published on the site and/or sent via email. From the moment of publication, the updated terms will apply.

3.4. Specific areas of the site may be subject to additional rules, which the member agrees to by using those areas.

3.5. The member irrevocably accepts that the company may transfer this agreement to third parties in accordance with Article 205 of the Turkish Code of Obligations.


ARTICLE 4 – GENERAL PROVISIONS

4.1. This agreement is governed by the laws of the Republic of Turkey. Any legal disputes will be resolved by the courts and enforcement offices of Istanbul.

4.2. The email address provided by the member will be used for all official communications.

4.3. If the email address changes, the member must notify the company within 3 days; otherwise, notifications sent to the old address will be considered valid.

4.4. Any email sent by the site will be deemed received by the member one (1) day after being sent.


ARTICLE 5 – MEMBER’S RIGHTS REGARDING PERSONAL DATA

5.1. In accordance with Article 11 of the Law on the Protection of Personal Data, the member has the right to send an email to [email protected] to:

  • (a) Learn whether their personal data has been processed;

  • (b) Request information regarding the processing;

  • (c) Learn the purpose of processing and whether it is used accordingly;

  • (d) Learn about third parties to whom the data is transferred;

  • (e) Request correction if the data is incomplete or incorrect;

  • (f) Request deletion or destruction under Article 7 of the Law;

  • (g) Request notification of corrections or deletions to third parties;

  • (h) Object to outcomes resulting from automated processing;

  • (i) Demand compensation if the data is used unlawfully.

5.2. The company will respond as quickly as possible. If the request requires additional cost, a fee may be charged in accordance with the tariff set by the Data Protection Authority.

By registering, the member declares that they have read, understood, and accepted all provisions of this agreement, and confirms the accuracy of the information provided.
